Dogs

There have been numerous incidents in Castle Peak involving unleashed dogs. Homeowners, and their leashed pets, walking the neighborhood have been charged and even attacked/bitten.

Canyon County regulations prohibits any dog "at large" (unrestrained) off the homeowner's property.

If you are threatened by an unrestrained dog on our streets or sidewalks, please report it to Animal Control via Caldwell’s non-emergency phone number 208-454-7531. If you don't file a complaint, the problem will continue.

CHAPTER 5
ANIMAL CONTROL REGULATIONS

"At Large" definition:
(1) Off the premises of the owner and not under the control of the owner or member of his immediate family, either by leash, cord, chain or other means of physical restraint.

(2) On the premises of the owner and not confined by substantial fence of sufficient strength and height to prevent the animal from escaping therefrom or secured on the premises by a metal chain, cable, adequately functional electronic containment fence, or other nondestructive device sufficient in strength to prevent the animal from escaping from premises and so arranged that the animal will remain upon the premises and not come any closer than six feet (6') to a public walkway or sidewalk when the restraint leash is stretched to full length.

03-05-15: RUNNING AT LARGE PROHIBITED:
(1) Canines:
A. Canine At Large: It shall be unlawful for any person to allow a canine which he owns, keeps, or harbors to be at large or to negligently fail, neglect or refuse to prevent a canine which he owns, keeps or harbors from being at large upon the roads, streets or alleys of the county or any public place of the county or upon any premises other than his own. Any person found in violation of this provision shall be guilty of an infraction and shall be punished as provided in Idaho Code section 18-113A, as amended.

Castle Peak CC&Rs:
4.17 Animals/Pets. No animals, birds, insects, pigeons, poultry or livestock shall be kept on the Property unless the presence of such creatures does not constitute a nuisance. This paragraph does not apply to the keeping of up to two (2) domesticated dogs, up to two (2) domesticated cats, and other household pets which do not unreasonably bother or constitute a nuisance to others. Without limiting the generality of the foregoing, consistent and/or chronic barking by dogs shall be considered a nuisance. Each dog in Castle Peak Subdivision shall be kept on a leash, curbed, and otherwise controlled at all times when such animal is off the premises of its owner. Such owner shall clean up any animal defecation immediately from the Common Area or public right-of-way. Failure to do so may result, at the Board's discretion, with a Limited Assessment levied against such animal owner. The construction of dog runs or other pet enclosures shall be subject to applicable ADC approval, shall be appropriately screened, and shall be maintained in a sanitary condition. Dog runs or other pet enclosures shall be placed a minimum of ten (10) feet from the side and/or rear Building Lot line, shall not be placed in any front yard of a Building Lot, and shall be screened from view so as not to be visible from Common Area or an adjacent Building Lot.
